Important guidelines  before buying a property in Turkey

After the real estate laws in Turkey allowed foreigners to own property in it, and  after the demand witnessed  by the  Turkish  real estate market to buy real estate from foreigners and Arabs, it was necessary and obligatory to draw attention to the most important steps and tips to be followed before making the purchase, in order to avoid fraud by some, and here are the most important of these tips:

  • Good knowledge of the real estate company you will be dealing with and be trustworthy or tested by a friend.
  • Extracting the real estate appraisal  report: The extraction of  the real estate appraisal report has become  mandatory to protect investors from price manipulation before buying a property in Turkey, and the  report deals with the property information with all details, pricing factors, and its legal, financial, and engineering affairs.
  • Ensure the property information in legal Turkey: where the seller's information must be verified, that he owns the  property in full and that there are no debts owed on the property.
  • Focus on the location of the property in Turkey and the features in it.


Asking about the maintenance fees for the property, residential properties, i.e. those  located in  ordinary buildings outside  a residential complex, will not include high  maintenance fees, while properties that  are located in a residential complex will find maintenance fees  for them that vary according to the quality of the complex, such as a private swimming pool or several swimming pools according to the size  of  the  residential complex and the presence of a fitness area, and therefore the   price of the property will increase  by increasing its maintenance fees.

  • Ensure that there are penalty clauses in the contract to protect you from any damage.
  • Obtaining permission from the Turkish army stating that this property is not close to a military base, permission can be obtained locally and takes only 2-4 weeks to receive it.
  • Thinking in a profitable business style:  The buyer must think in a practical way that guarantees him the benefit of the apartment to be purchased, as buying apartments in a tourist country such as Turkey often exceeds the limits of housing, so it is better and profitable for the buyer  to buy commercial and tourist apartments in order to operate them, to become a source of funds.
  • Check that there are no restrictions or seizure signs on the property of Turkey : such as mortgage or seizure signs that prevent the process of buying and selling, which is likely to directly affect its price, depending on the type of signal or violation.
  • Check the type of title deed  (Tapu): The types of real estate title deeds used in the procedures of buying and selling the property may be similar,  for example, if  the property deed is a temporary title deed, as is the case in  Turkish real estate under construction  or that has not yet begun construction, in this case it must be ensured that there are no obstacles that would hinder the conversion of the temporary ownership right of the property, to a   permanent ownership right after the completion of construction, such as the completion of construction licenses And reconstruction of the real estate project, and the like of the relevant licenses and permissions.
  • Check the type of allocation of the property: residential or commercial: It is necessary to ensure the main purpose of establishing the property in question, by reviewing the municipality or the Land Survey Department, for example, if the property in question is a housing unit, it is considered to fall within the scope of residential units, and is the property intended for the establishment of housing units or intended for other things?
  • Completing the ownership procedures in the title deed department exclusively: where any unofficial contracts issued by the notary public, the mukhtar or other parties are considered "insufficient", and do not prove that the ownership of the specified property has been transferred to the buyer.  
  • Translation of the sales contract into Arabic : It is better to get a copy of the sales contract translated into Arabic or any language you want.

 

In conclusion, we would like to emphasize that the buyer's dealings with a well-known and reputable real estate company , can avoid many risks that can occur in the purchase process.
